Summary of Pending Case: Funeral Consumers Alliance, Inc. et al., v. Service Corporation International, et al. (S.D. Tex.). The firm represents plaintiff consumer purchasers in a class action alleging that funeral home owner operators and a casket manufacturer conspired among themselves in an attempt to monopolize the market for caskets and to restrain trade and foreclose competition. Plaintiffs allege that this conduct foreclosed a discount channel of distribution and caused casket prices in defendants' funeral homes to be artificially inflated.
The district court denied defendants' motions to dismiss. A report and recommendation by the Magistrate Judge recommending the denial of plaintiffs' motion for class certification has been upheld by the district court. Plaintiffs have asked the U.S. Court of Appeals for the Fifth Circuit for leave to appeal the lower court's order denying class certification.
